Food delivery services have become one of the most popular trends across several cities in California, including San Bernardino. People love the idea of ordering food at the comfort of their own home. With the convenience that comes along with this service, it is no wonder that food delivery companies, such as Grubhub, DoorDash, and Postmates, have grown in popularity throughout the past few years. Even though there are perks that come along with food delivery, there are some downsides to it that should be noticed, as well.
One of the biggest issues with food delivery services is the expectation that the food delivery driver will always arrive on time to drop off the customer’s order. Not many people are aware of the stress and time management that comes along with this obligation. Food delivery drivers are put under immense pressure to make sure customers are satisfied with their experience. If not, then the food delivery driver will likely face harsh consequences, such as losing their job. To prevent this from happening, a food delivery driver may commit negligent actions, such as speeding or disobeying traffic laws, to make it on time to the customer’s address. This can create a dangerous environment that can affect every driver, bicyclist, or pedestrian nearby.

There are several factors that can contribute to the cause of a food delivery accident.
Distracted driving, such as texting and driving, has gotten food delivery driver’s in many accidents. Even though a food delivery driver is expected to solely focus on their job, they may get distracted by text messages or phone calls and succumb to the sound of a notification or ringtone.
Delivering an order while in a hurry has also been a common issue that has contributed to the cause of a food delivery accident. According to some estimates, close to 20 percent of Americans use a food delivery service on a weekly basis. In a city as populated as San Bernardino, that’s a lot of deliveries. Given the volume of business these services deal with, it’s no surprise that their drivers are in such a rush to make as many deliveries as possible. Drivers are under great pressure to deliver their orders quickly to avoid customer complaints. Their very livelihood depends on it. This pressure to perform can easily influence them to drive recklessly.
While a food delivery driver is attempting to locate a customer’s address, they could become lost during this process. A lost driver who is in an unfamiliar location may focus more on looking at their phone to check their GPS rather than keeping their eyes on the road. This could result in sudden stops and dangerous turns. A sudden stop could cause a driver from behind to rear-end the food delivery driver. A food delivery driver who performs dangerous left or right turns without properly checking their surroundings could cause a side-impact or head-on accident with another driver nearby. These types of collisions may trigger serious injuries and property damage. The food delivery driver will likely be subject to liability for the accident.
According to the United States Department of Justice, Subsection (a) of 18 U.S.C. § 1365 “prohibits tampering or attempted tampering with any consumer product that affects interstate or foreign commerce, or with the labeling of, or the container for such a product. The tampering must be done with reckless disregard for the risk that another person will be placed in danger of death or bodily injury. Furthermore, the tampering must be done under circumstances manifesting extreme indifference to the risk of death or bodily injury.”
The above is fairly straightforward and can sometimes apply to food delivery tampering. However, California is a bit more specific regarding food tampering.
California PEN § 347 states that any individual who deliberately and knowingly adds a poison or harmful substance to a drink, food, medicine, or pharmaceutical product in situations where someone can be harmed, may then be found guilty of a felony which can be punished with a prison sentence of 2 to 5 years. Furthermore, a substance that causes severe physical injury or death will add three more years to that individual’s sentence.
This may not provide much comfort to someone who just ordered large fries, however, do know that a food delivery driver who deliberately spits on someone’s food while in full awareness of being sick can get into serious trouble.
